Court Certifies Loan Officers and Processors FLSA Overtime Collective Action Against Freedom Mortgage Corporation and Orders Notice Be Sent to Current and Former Employees
On November 2, 2009, the U.S. District Court for the District of New Jersey conditionally certified a collective action to recover Fair Labor Standards Act (FLSA) overtime brought on behalf of loan officers and loan processors who either currently work at Freedom Mortgage Corporation (FMC) or worked at FMC at any time after January 28, 2006. The court ordered FMC to provide the names and addresses of all loan officers and processors who worked for FMC since January 28, 2006, so that the Court-approved Notice regarding the lawsuit could be sent to the employees. FMC has twenty (20) days from the date of the Order to provide this information to Woodley & McGillivary, and then employees will need to complete a consent-to-sue form and return it to Woodley & McGillivary to participate in the lawsuit. Click here to review the court ordered notice, and click here to view the consent form.
Only those employees who return the consent-to-sue form to Woodley & McGillivary will participate in the lawsuit and be eligible to recover the damages the case seeks. The lawsuit seeks unpaid overtime conpensation, liquidated damages and/or interest, and attorney's fees.
